Disclaimer and Limitation of Liability – Verasitas Labs Corporate, S.A.
1. Preamble and Scope of Services.
Verasitas Labs Corporate, S.A. (hereinafter, “the Company”), operates strictly as a third-party analytical and evaluative entity. The services provided are limited to the characterization and quantification of pharmacological components and/or active ingredients, performed exclusively upon the physical samples submitted by the client (hereinafter, “the Samples”), in the specific state and condition in which they were received at the time of analysis.
2. Fundamental Limitation of Results.
All data, reports, certificates, and any other outputs derived from the analytical procedures (collectively, “the Results”) must be interpreted solely and exclusively within the context of the specific Samples analyzed and under the pre-defined and validated methodological conditions. The Company does not extend, either implicitly or explicitly, the obtained Results to production batches other than those from which the Samples were derived. Furthermore, the Company assumes no responsibility for any inherent variability attributable to manufacturing processes, stability, storage conditions, or transport logistics, over which the Company exercises no control and in which it is not a participating party.
3. Absence of Value Judgments or Commercial Endorsements.
The issuance of Results by the Company shall in no event be construed as a certification, endorsement, warranty, recommendation, promotion, or disapproval of the finished product, its manufacturer, or any associated commercial entity. The Company’s role is confined to reporting objective analytical findings on the Samples received, and it expressly refrains from making any declarations whatsoever regarding the overall suitability, efficacy, safety, or commercial quality of the product from which they originated. Any inference drawn in such a direction falls entirely outside the Company’s scope of responsibility.
4. Critical Advisory on Medicinal Product Use and Professional Supervision.
The Company must emphasize in the strongest terms possible that the technical information contained within its Results does not, under any circumstances, constitute medical advice, diagnosis, or a prescription. The consumption, administration, or utilization of any pharmaceutical product or active ingredient must be conducted exclusively under the strict supervision, prescription, and monitoring of a duly qualified healthcare professional (e.g., physician, pharmacist). This serves as an express warning of the severe health risks, including the potential for adverse reactions, drug interactions, or counter-therapeutic effects, associated with self-medication or any deviation from the instructions provided by a qualified medical practitioner.
5. Acceptance of Terms.
The request for services and the subsequent receipt of the Results by the client implies full and unconditional acceptance of the terms and limitations set forth herein. This agreement serves to fully indemnify and hold harmless Verasitas Labs Corporate, S.A., its directors, employees, and agents, from any and all claims, demands, or legal liability that may arise from the use, misinterpretation, or application of said Results beyond the strictly technical and objective framework for which they were generated.
